HB582 Summary

• Amends Alabama Code Sections 14-11-30 and 14-11-31 to expand the definition of custodial sexual misconduct to include employees of community corrections and punishment programs and alcohol or drug abuse court referral and treatment programs.

• Expands the definition of "employee" to include agents or contractors of facilities who provide supervision, treatment, care, custody, control, or authority over persons referred or ordered by state, county, or municipal authorities.

• Makes it unlawful for any employee to engage in sexual conduct with a person under the supervisory, disciplinary, or custodial authority of a community corrections and punishment program or an alcohol or drug abuse court referral and treatment program.

• Classifies custodial sexual misconduct as a Class C felony and specifies that consent of the person in custody is not a defense to prosecution.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
