• Applies to privately-owned wastewater systems in Marshall County that serve one or more developments, discharge directly to surface waters, are regulated by the Department of Environmental Management, and serve fewer than 200 customers.

• Requires the Alabama Public Service Commission to promulgate and enforce rules to certify and monitor the economic viability of these wastewater management systems.

• Mandates that rate charges to customers for wastewater system service must be approved by the Public Service Commission under existing utility laws, rules, regulations, and procedures.

• Becomes effective immediately upon passage and gubernatorial approval or upon otherwise becoming law.
