HB76 Summary

• Amends Sections 22-25C-1 and 22-25C-2 of the Code of Alabama 1975 to modify requirements for centralized waste treatment facilities permitted by the Alabama Department of Environmental Management (ADEM).

• Clarifies that owners or operators must post a performance bond or other financial assurance sufficient to close facilities if operations cease, are abandoned, or fail to maintain compliance with state environmental regulations.

• Repeals the five percent fee requirement on facility treatment costs and eliminates the ADEM Centralized Waste Treatment Facility Rehabilitation Fund that previously collected these fees.

• Requires owners or operators to submit minimum two detailed written closure cost estimates prior to permit issuance or modification and to re-evaluate estimates if facility changes would significantly increase closure costs.

• Mandates refunds of all fees collected under the former fee structure prior to this bill's enactment and makes the act effective immediately upon passage and gubernatorial approval.
