HB92 Summary

• Increases district court jurisdiction from $10,000 to $20,000 for cases where the amount in controversy does not exceed that limit, exclusive of interest and costs.

• Increases circuit court's exclusive original jurisdiction threshold from $10,000 to $20,000, while maintaining concurrent jurisdiction with district court for cases exceeding $6,000.

• Revises filing fees in Section 12-19-71 to reflect the new $20,000 jurisdiction limit, including increasing the fee for district court cases exceeding $3,000 from the previous $10,000 cap to a $20,000 cap.

• Maintains the same filing fee amounts for the small claims division of district court ($35, $109, and $198 depending on amount in controversy).

• Updates filing fee distribution provisions in Section 12-19-72 to allocate fees to the Fair Trial Tax Fund, State General Fund, Advanced Technology and Data Exchange Fund, and county general funds according to case type and amount.

• Becomes effective January 1, 2017.
