SB1 Summary

• Establishes the Alabama Privacy Act requiring persons and entities that operate public restrooms, bathrooms, or changing facilities to ensure privacy for users.

• Permits three compliance options: single-occupancy facilities, multiple-occupancy facilities designated for one gender, or multi-gender facilities staffed by an attendant stationed at the door to monitor appropriate use.

• Imposes civil penalties of at least $2,000 for first violations and at least $3,500 for subsequent violations, payable to the local governing body that issued the facility license.

• Creates private civil cause of action allowing individuals to recover actual damages of at least $1,000 or up to three times actual damages in punitive damages, plus attorney's fees and costs if successful.

• Enforcement authorized by any state or local law enforcement agency; Attorney General and district attorneys may bring representative actions limited to actual damages plus reasonable attorney's fees and costs.
