SB113 Summary

• Amends Alabama Code Sections 22-25C-1 and 22-25C-2 regarding centralized waste treatment facilities permitted by the Department of Environmental Management (ADEM).

• Requires facility owners or operators to post a performance bond or other financial assurance in an amount sufficient to close the facility if the owner ceases proper operation, abandons the facility, or fails to maintain compliance with state environmental regulations.

• Repeals the requirement that facilities charge a five percent fee on treatment costs and eliminates the ADEM Centralized Waste Treatment Facility Rehabilitation Fund.

• Requires owners or operators to submit minimum two detailed written cost estimates for facility closure prior to permit issuance and to re-evaluate estimates if facility changes significantly increase closure costs.

• Provides that all fees collected under the previous fee structure prior to this bill's enactment shall be refunded to the owners or operators who paid them.
