SB151 Summary

• Removes service area restrictions on public providers (municipalities and municipal instrumentalities) allowing them to provide cable systems, telecommunications equipment, Internet access, and related services without geographic limitations.

• Requires public providers intending to serve areas outside their jurisdiction to give 12-month notice to existing private providers, allowing them to determine if they will match service levels.

• Restricts public providers' expanded service to only their home county and contiguous counties, limiting services outside their boundaries to Internet, cable, and phone only (not power, water, or other utilities).

• Prohibits use of public funds for expansion; only revenue bonds, cash, grants, loans, or matching dollars may finance service outside municipal boundaries.

• Municipalities providing service outside their boundaries as of January 31, 2016, must pay all applicable taxes and fees as if they were a private entity.
