SB210 Summary

• Amends Section 26-2A-137 of the Alabama Code to explicitly authorize courts to approve leasing of oil, gas, and mineral rights as part of protective arrangements for protected persons.

• Allows courts to authorize, direct, or ratify such leases when a basis exists for appointing a conservator or issuing a protective order, without requiring the appointment of a conservator.

• Applies to both protective arrangements (Section a) and property/business affairs transactions (Section b), with the court determining that the transaction is in the best interest of the protected person.

• Requires courts to consider the interests of creditors and dependents before approving such arrangements and may appoint a special conservator to assist in accomplishing authorized transactions.

• Takes effect immediately upon passage and approval by the Governor.
