SB25 Summary

• Amends Section 24-1-27 of the Code of Alabama 1975 to extend limited tort immunity to non-profit affiliate corporations of Alabama Public Housing Authorities.

• Non-profit corporate affiliates qualify as governmental entities for tort immunity purposes if they meet four criteria: the housing authority's board constitutes the corporate board, the authority's executive director serves as corporate president, organizational documents require public housing assets return to the authority upon change of control, and the sole purpose is developing, owning, managing, operating, or maintaining low-income housing.

• Tort suits against qualifying corporate agents become subject to the limitations and provisions of Chapter 93 of Title 11 (Alabama's governmental immunity statute).

• Effective date is the first day of the third month following passage and gubernatorial approval.
