• Alters the local approval process for new solid waste management facilities by establishing a detailed procedure including public awareness sessions, public hearings, and a 30-day review period for local governing bodies to approve or deny applications.

• Removes the requirement that proposed new solid waste management facilities or permit modifications be evaluated by regional planning and development commissions.

• Requires applicants whose local approval is granted to petition circuit court under Rule 57 of Alabama Rules of Civil Procedure for a determination of whether the local governing body complied with public notice requirements and properly considered the application against local solid waste management plans.

• Circuit court must issue a ruling within 60 days (extendable up to 30 additional days) on the local governing body's approval, with opportunity for parties to mitigate discrepancies if the court rejects the approval.

• Does not apply to industrial facilities receiving wastes generated on site only or by the permittee, and does not apply to applications received prior to the effective date.
