SB266 Summary

• Allows incorporated municipalities to annex unincorporated territory that is 15 acres or less and has been enclosed within the municipality's corporate limits for one year or more.

• Requires municipalities to provide certified or registered mail notice to property owners at least 90 days before annexation consideration, with owners given opportunity to consent or withhold consent in writing or at a council hearing.

• Prohibits annexation if the owner or owners withhold consent; if consent is withheld, the municipality cannot propose annexation of the same property for at least three years.

• Allows annexation to proceed by ordinance if owners do not signify intent to withhold consent after receiving notice and opportunity for hearing, with the ordinance and map filed in the probate judge's office.

• Prohibits annexation of any industrial parks established under Chapter 23 of Title 11, Code of Alabama 1975.
