Residential home builders licensed under Chapter 14A of Title 34, Code of Alabama 1975 must provide homeowners proof of current licensure by the Home Builders Licensure Board and liability insurance before beginning construction.

The requirement may be waived if the homeowner and builder execute a written waiver signed by both parties and attested by one witness selected by the homeowner.

Failure to comply with the requirement constitutes a violation of Chapter 14A of Title 34, Code of Alabama 1975 and is subject to board enforcement action under Section 34-14A-14.

The act becomes effective on the first day of the third month following passage and approval by the Governor, or upon otherwise becoming law.
