SB322 Summary

• Creates a new category of community development district (subsection i) that must border a lake formed by an impounded reservoir from a river originating in a federal wilderness area, with a marina of at least 30 boat slips and a restaurant with minimum 100 seats (50 inside seating).

• Requires the marina and restaurant to be under common ownership and located on the same property, with the restaurant obtaining a business license from the local governing body and subject to additional local regulation.

• Limits one restaurant license per community development district of this type and prohibits more than one restaurant license per district.

• Authorizes the sale of alcoholic beverages in the new district type for on-premises consumption upon approval by majority vote of the board of control and licensing by the Alabama Alcoholic Beverage Control Board.

• Establishes a one-time filing fee of $500 payable to the county where the district is located for purposes of funding the probate judge's office.
