SB367 - Alabama Medicaid False Claims Act

• Establishes the Alabama Medicaid False Claims Act to provide civil remedies for fraudulent claims against the state Medicaid program.

• Imposes liability of three times actual damages plus civil penalties of $5,500 to $11,000 per claim (adjusted for inflation) on persons who knowingly present false claims, make fraudulent records, or conceal obligations to the Medicaid program.

• Authorizes the Attorney General to investigate violations and bring civil actions, and allows private persons to bring civil actions on behalf of the state with potential recovery of 15-30% of proceeds depending on state involvement.

• Prohibits employers from retaliating against employees, contractors, or agents who disclose information about false claims to government agencies, with remedies including reinstatement, back pay, and attorney's fees.

• Establishes statute of limitations of six years from violation date or three years from discovery (whichever is later, but not more than ten years total), and permits nationwide service of process for actions under this act.
