• Amends Section 11-50B-3 of the Alabama Code to specify that right-of-way fees charged to telecommunications providers must be cost-based.

• Prohibits fair and reasonable compensation from telecommunications providers from including in-kind fiber or network build-out requirements.

• Establishes that right-of-way fees may be structured as a permitting fee, a fee per linear foot, or a percentage of gross revenues originating and terminating in the city limits less wholesale revenues, but all must be cost-based.

• Maintains state and local governmental agencies' authority to manage public rights-of-way and require compensation from telecommunications providers on a competitively neutral and nondiscriminatory basis.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
