SB82 Summary

• Establishes the Marshall James Walton Highway Safety Act and creates the crime of homicide by vehicle or vessel in Alabama.

• Makes a person guilty of homicide by vehicle when they cause another person's death while knowingly violating Title 32, Chapter 5A vehicle operation laws (excluding Section 32-5A-191), if the violation is the proximate cause of death.

• Classifies conviction for homicide by vehicle as a Class C felony.

• Requires the Administrative Office of Courts and Office of Prosecution Services to report statistical information on this charge to the Legislature by the tenth day of the 2022 Legislative Regular Session.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
