Amends Section 20-1-6 of the Code of Alabama 1975 to expand the definition of "perishable food" to explicitly include foods prepared at restaurants or food service establishments required to obtain a food service permit from the Alabama Department of Public Health.

Extends existing limited immunity protections to donors and charitable/nonprofit organizations distributing prepared restaurant foods, protecting them from criminal and civil liability for injuries or death unless caused by gross negligence, recklessness, or intentional misconduct.

Maintains that immunity applies only when donated food is apparently fit for human consumption at the time of donation and is distributed free of charge to bona fide charitable or nonprofit organizations.

Preserves the authority of appropriate agencies to regulate or ban the use of such food for human consumption.

Becomes effective on the first day of the third month following passage and approval by the Governor.
