• Amends Alabama Code sections 22-25C-1 and 22-25C-2 to modify requirements for centralized waste treatment facilities permitted by the Alabama Department of Environmental Management (ADEM).

• Clarifies that performance bonds or financial assurance required from facility owners/operators must be forfeited when operators cease proper operation, abandon the facility, or fail to maintain compliance with environmental regulations, with forfeited funds used for facility closure and remediation costs.

• Eliminates the requirement that facilities charge a five percent fee on treatment costs, effectively repealing the provisions creating the Centralized Waste Treatment Facility Rehabilitation Fund.

• Requires facilities to submit minimum two detailed written closure cost estimates in current dollars prior to permit issuance or modification, and to re-evaluate estimates if facility changes significantly increase closure costs.

• Mandates refunds of all fees previously collected under the eliminated five percent fee requirement to the facility owners or operators that paid them.
