AL HB115

Amends Section 13A-5-40 of the Alabama Code to add two new enumerated capital offenses: murder on the campus of a school and murder in a day care center or licensed child care facility.

Defines "school" to include public or private institutions of learning from pre-kindergarten through grade 12, technical or vocational schools, community colleges, two-year postsecondary institutions, and any institution of higher learning.

Defines "day care center or licensed or statutorily exempted child care facility" according to Section 38-7-2.

Exempts the bill from Amendment 621 of the Alabama Constitution because it defines a new crime or amends the definition of an existing crime.

Effective on the first day of the third month following passage and approval by the Governor.
