HB118 Summary

• Amends Section 40-23-5 of the Code of Alabama 1975 to add the Zoo Foundation, Inc. (operating as Alabama Gulf Coast Zoo) as a tax-exempt entity.

• Exempts the Alabama Gulf Coast Zoo from state, county, and municipal sales and use taxes on all capital expenditures, while remaining subject to all other taxes.

• Requires county commission authorization by resolution before the zoo may claim exemption from county sales and use taxes.

• Limits the exemption to September 30, 2022, requiring the organization to report annually to the Department of Revenue on sales for which the exemption is claimed.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
