HB139 - New Assistive Devices Warranty Act

• Establishes warranty protections for assistive devices costing $5,000 or more, including wheelchairs, motorized scooters, voice synthesizers, optical scanners, and Braille printers used for major life activities.

• Requires manufacturers, dealers, or lessors to repair nonconformities reported by consumers within the express warranty period or provide either a full refund or replacement device at consumer's choice.

• Manufacturers must provide replacement comparable devices within 30 days of consumer's offer to return the defective device, with refunds including purchase price, finance charges, sales tax, and collateral costs minus reasonable allowance for use.

• Excludes from coverage disposable devices with useful life of one year or less, batteries, nonfunctional accessories, and devices dispensed or implanted by licensed physicians.

• Allows consumers to recover damages within four years of violation, with courts authorized to award up to treble damages plus costs, disbursements, and reasonable attorney fees; any waiver of rights is void.
