HB167 Summary

• Amends Section 40-18-140 of the Alabama Code to add a new income tax refund check-off option for contributions to the Alabama State Veterans Cemetery at Spanish Fort Foundation, Incorporated, beginning in the 2018 tax year.

• Allows Alabama resident individual income taxpayers to designate a portion of their refund (rounded to whole dollars) to contribute to the foundation by checking an appropriate box on their state income tax return form.

• Contributions received shall be deposited with the State Treasurer for distribution to the Alabama State Veterans Cemetery at Spanish Fort Foundation, Incorporated, less administration costs not to exceed five percent.

• Check-off authorization is subject to an existing provision that requires any check-off receiving less than $7,500 in average annual gross contributions over a three-year period to be dropped from tax forms and repealed.

• Act becomes effective on the first day of the third month following passage and approval by the Governor, or upon otherwise becoming law.
