• Department of Transportation may enter into road construction or maintenance contracts up to $250,000 without advertising for sealed bids, provided the project is listed on the department website for at least seven calendar days beforehand.

• Total cost of all projects exempted from sealed bid requirements under this provision cannot exceed $1,000,000 in the aggregate per year.

• Amends Section 39-2-2 of the Code of Alabama 1975 to add a new subsection (j) creating this exemption specifically for the Department of Transportation.

• All other governmental bodies continue to be subject to existing competitive bidding requirements for public works projects exceeding $50,000.

• Act becomes effective immediately upon passage and gubernatorial approval.
