AL HB26

Makes it unlawful for any person to smoke a tobacco product in a motor vehicle, whether in motion or at rest, when a minor is a passenger in the vehicle.

Defines "smoke" and "tobacco product" by reference to existing Alabama Code sections 22-15A-3(10) and 28-11-2(10).

Violations are punishable by a fine not exceeding $100 for each violation.

Bill is exempted from Amendment 621 constitutional requirements regarding local expenditures because it defines a new crime.

Act becomes effective on the first day of the third month following passage and approval by the Governor, or its otherwise becoming law.
