• Revises unlawful possession of marijuana in the first degree to require possession of two or more ounces, classified as a Class C felony.

• Changes unlawful possession of marijuana in the second degree (more than one ounce but less than two ounces for personal use) from a Class A misdemeanor to a Class D felony.

• Creates a new crime of unlawful possession of marijuana in the third degree for possession of one ounce or less, with first or second offenses as violations punishable by fines up to $250, and third or subsequent offenses as violations punishable by fines up to $500.

• Excludes edible cannabis derivatives from the third degree possession charges and prohibits charging third degree violations alongside paraphernalia charges under Section 13A-12-260.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
