HB 38 Summary

• Amends Section 12-15-319 of the Alabama Code to add conviction for first-degree rape as grounds for termination of parental rights.

• Parental rights may be terminated if a person is convicted of rape in the first degree under Section 13A-6-61 when the rape results in conception of the child.

• Adds this provision as factor (13) to the existing list of circumstances courts must consider when determining whether to terminate parental rights.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
