HB393 Summary

• Requires all Department of Public Health rules for onsite sewage treatment and disposal systems to be applied uniformly based on performance and functionality rather than material specifications.

• Prohibits the Department from implementing or enforcing rules that restrict onsite sewage systems based on different types of materials or media used, unless the rule has technical justification.

• Voids any department rules that became effective in March 2017 and are applied based on the type of material or media used during treatment or dispersal of effluents.

• Protects systems that have already proven successful under the regulatory scheme in place prior to March 2017 from being restricted under new material-based rules.

• Becomes effective immediately upon passage and Governor approval.
