HB 423 Summary

• Municipal judges or magistrates of the Town of Webb may assess a $100 warrant recall fee to defendants for recalling failure to appear warrants arising from municipal ordinance violations.

• The defendant must pay the $100 fee at the time the warrant is recalled.

• The Town of Webb is not required to recall any issued warrant; all recall decisions are solely at the discretion of the municipal judge or magistrate.

• All warrant recall fees collected by the Town of Webb Municipal Court shall be deposited into the Town of Webb Corrections Fund and allocated according to Alabama Code Section 11-47-7.1(a).

• The act becomes effective immediately upon passage and approval by the Governor or upon otherwise becoming law.
