Municipal judges or magistrates in the City of Fairfield may assess a $100 warrant recall fee to defendants seeking to recall a failure to appear warrant for municipal ordinance violations.

The warrant recall fee must be paid by the defendant at the time the warrant is recalled.

Warrant recall is discretionary and cannot be required; municipal judges and magistrates have sole discretion to issue recall orders.

All fees collected from warrant recalls shall be deposited into the City of Fairfield Corrections Fund and allocated in conformity with Section 11-47-7.1 of the Code of Alabama 1975.

The act becomes effective immediately upon passage and approval by the Governor, or upon otherwise becoming law.
