HB503 Summary

• Amends Alabama Code Sections 35-8B-1, 35-8B-2, and 35-8B-3 to create an additional class of community development district in wet counties that do not authorize Sunday alcoholic beverage sales.

• Establishes a new district type (subsection m) for commercial districts in wet counties without Sunday sales that have a restaurant with at least 96 inside and 24 outside seats, located on a lake with adjacent docking facilities for at least 24 boats, licensed only for beer and wine sales, with marina and restaurant under common ownership.

• Authorizes the sale of alcoholic beverages on Sunday within qualifying community development districts upon incorporation and board approval, subject to existing Alcoholic Beverage Control Board licensing requirements.

• Specifies that districts under subsections (e) through (m) require only owner consent and filing articles of establishment with the probate judge, with a one-time filing fee of $500 payable to the county.

• Makes the act effective immediately upon passage and approval by the Governor.
