HB52 Summary

• Requires abortion providers to inform women in writing (16-point type or larger) of their right to withdraw consent to an abortion at any time before the procedure is performed.

• Mandates a full refund of all abortion fees if a woman withdraws consent before the abortion is performed: for surgical abortions, refundable until the moment the unborn child is aborted; for medication abortions, refundable until the woman leaves the facility with the dispensed medications.

• Requires refunds to be issued within three business days after the date of cancellation.

• Creates civil penalties for failure to provide refunds, including compensatory and punitive damages of at least $10,000 plus attorney fees, with claims eligible to be filed within two years of non-compliance.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
