HB69 Summary

• Amends Alabama public works law (Sections 39-1-5 and 39-2-2) to create an exception for heating and air conditioning unit purchases and installations by counties, municipalities, and local school boards.

• Allows entities to bypass standard public works bidding requirements when purchasing HVAC units through the National Association of Counties and National League of Cities purchasing cooperative, provided the cooperative's bid process has been approved by the Department of Examiners of Public Accounts.

• Requires the HVAC purchase price to be equal to or less than prices available through the state purchasing program, or unavailable on the state program at the time of purchase.

• Mandates the entity receive written notification from the Department of Examiners of Public Accounts confirming the cooperative's competitive bid process complies with state competitive bid laws.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
