Public water systems must provide written notice to the State Health Officer at least 90 days before making any permanent change to fluoridation status, including discontinuing fluoridation or reducing fluoride levels below CDC-recommended optimal levels.

Notice must include the proposed date of the change, reasons for the change, and all communities affected by the change.

Public water systems that fail to provide proper notification must resume fluoridation at previous levels until they notify the State Health Officer.

Temporary fluoridation discontinuances caused by equipment failure, maintenance, chemical supply shortages, or other unavoidable circumstances are exempt from notification requirements.

The act becomes effective on the first day of the third month following passage and approval by the Governor.
