SB184 Summary

• Adds Section 8-29-9 to the Code of Alabama 1975 to establish requirements for public-private agreements involving development or construction on public property or right-of-way.

• Requires entities entering into public-private agreements of $50,000 or more to comply with Section 39-1-1 requirements (public works contract standards), regardless of funding source.

• Defines three key terms: "private contribution" (resources supplied by private entities including funds, materials, or services), "public benefit" (grants of rights or revenue from the construction project), and "public-private agreement" (nontraditional arrangements between property owners and private entities).

• Preserves the right of damaged parties to seek recovery under Section 39-1-1 or other applicable law if compliance requirements are not met.

• Effective date: first day of the third month following passage and approval by the Governor.
