SB218 - Railroad Authorities Summary

• Authorizes existing railroad authorities to amend their certificates of incorporation by majority vote of the board of directors without requiring consent from any county or municipal governing body.

• Allows county commissions in counties where a railroad authority currently owns, leases, or controls property (but did not at the time of original incorporation) to elect two additional board members to the authority.

• Adds new definition of "qualifying county" to refer to counties with current railroad authority properties that were not authorizing subdivisions at the time of incorporation.

• Amended sections include board member selection procedures (§37-13-5), certificate of incorporation requirements (§37-13-4), definition of terms (§37-13-1), and authority powers (§37-13-7).

• Effective date is the first day of the third month following passage and gubernatorial approval.
