SB230 Summary

• Amends Alabama Code sections 35-8B-1, 35-8B-2, and 35-8B-3 to create additional classes of community development districts beyond residential developments to include commercial districts with specific amenities and geographic requirements.

• Adds nine new district types (subsections d through m) including resort properties with golf courses, marinas, restaurants, and overnight accommodations in dry and wet counties with specific minimum acreage, facility, and membership requirements.

• For districts under subsection (d), authorizes the sale and distribution of alcoholic beverages including draft or keg beer by Alcoholic Beverage Control Board licensees without restrictions under Section 35-8B-3.

• Establishes filing fees of $1,000 paid to the municipality or county where the district is located, plus $350 to the probate judge for districts under subsections (a), (b), or (d); and $500 one-time fee for other district types.

• Provides that if a majority board vote approves alcohol sales, licensees in districts under subsections (e) through (m) may sell alcoholic beverages for on-premises consumption seven days a week.
