• Amends unlawful possession of marijuana in the first degree to require possession of two or more ounces, classified as a Class C felony.

• Changes unlawful possession of marijuana in the second degree (more than one ounce but less than two ounces) from a Class A misdemeanor to a Class D felony.

• Creates new crime of unlawful possession of marijuana in the third degree for possession of one ounce or less, with first and second offenses as violations punishable by fines up to $250, and third or subsequent offenses as violations punishable by fines up to $500.

• Exempts edible cannabis derivatives (foods, drinks, candies) and Cannabidiol (CBD) from the third-degree possession penalties.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
