SB254 Summary

• Authorizes on-premises retail licensees to infuse alcoholic beverages by combining distilled spirits with nonalcoholic food products (spices, herbs, fruits, vegetables, candy) for on-site consumption only.

• Requires written notification to the Alcoholic Beverage Control Board and limits infusion containers to 5 gallons maximum, with all batches disposed of within 22 days of preparation.

• Mandates labeling of infusions with alcohol statement, recipe title, preparer name, production date, expiration date, spirit brand/type, amount of spirits used, and complete ingredient list.

• Prohibits infusions from containing stimulants (caffeine, guarana, ginseng, taurine, marijuana, energy drinks), being removed from licensed premises, or being stored in original liquor bottles.

• Effective date is the first day of the third month following passage and approval by the Governor; passed by Senate 26-0 on February 27, 2018.
