SB305 Summary

• Amends Alabama Code Sections 35-8B-1, 35-8B-2, and 35-8B-3 to create an additional class of community development districts designated subsection (m).

• Defines new district type (subsection m) as privately owned property for social purposes with at least 250 contiguous acres, a marina with 150+ boat storage spaces, a 2,200+ square foot shipstore, adjacency to a 100,000+ acre lake, and a restaurant with 40+ seat capacity in a dry county with wet municipalities.

• Authorizes on-premises alcoholic beverage sales in all community development districts with board of control approval, subject to Alabama Alcoholic Beverage Control Board licensing.

• For the new subsection (m) districts, permits any appropriately licensed person to sell alcoholic beverages on any day of the week for on-premises consumption without membership restrictions.

• Establishes filing fees of $1,000 payable to the municipality or county (depending on location) plus $350 to the county probate judge's office for districts under subsections (a), (b), or (d), and $500 one-time fee for districts under subsections (e) through (m).
