SB5 Summary

• Amends Section 41-22-5 of the Code of Alabama 1975 to require agencies to disclose whether proposed rules relate to or affect any litigation involving the agency.

• Notice of intended action for rule adoption, amendment, or repeal must state whether the proposed action relates to or affects any litigation the agency is a party to concerning the rule's subject matter.

• Maintains existing notice requirements including at least 35 days' notice published in the Alabama Administrative Monthly and provision for public comment periods.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
