SB7 Summary

• Authorizes civil forfeiture of all property used in, intended for, or derived from acts of terrorism as defined under Alabama Code Article 7, Chapter 10, Title 13A.

• Allows persons injured by terrorist acts, law enforcement agencies, and private entities to file claims for costs and damages satisfied from forfeited property, with filing fees of $100-$400 depending on amount in controversy.

• Establishes a five-year limitation period for claims and requires allocation of forfeiture proceeds first to satisfy judgments for injured persons, then to investigation costs, prosecution costs, and mitigation/seizure costs for participating agencies.

• Permits injured persons to sue the terrorist directly in circuit court for actual damages plus punitive damages of at least three times actual damages, with attorney's fees available to prevailing parties.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
