Department of Public Health shall establish a free special permit for recreational growing and harvesting of oysters in salt and brackish waters adjacent to applicant's primary residence, in compliance with National Shellfish Sanitation Program standards.

Permit applicants must sign a sworn statement confirming regular participation in recreational oyster farming and that they purchase seed oysters or spats from Alabama commercial growers, state colleges, universities, or state agencies.

Applicants must provide email address, telephone number, and mailing address to receive public health notices regarding oyster consumption safety; permits are valid for one year and renewable upon filing new statements annually.

Permit holders receive an income tax credit of $125 per tax year for participating in the program; participants in oyster programs authorized by state agencies, colleges, universities, counties, or municipalities can claim the same credit with a sworn statement.

Act becomes effective on the first day of the third month following passage and gubernatorial approval; passed by House of Representatives on May 14, 2019 with 99 yeas, 0 nays, and 1 abstention.
