HB11 Summary

• Requires hospitals to seek compensation solely from an injured person's health insurance provider, except for approved copayments and deductibles, unless certain circumstances apply.

• Hospitals may perfect a lien only after submitting an accurate claim to the health care payor and receiving a denial, with lien perfection required within 20 days of denial or within 20 days of discharge if coverage status is unknown.

• Hospitals must file verified lien statements with the probate court within 10 days of patient discharge, including patient and defendant information, and mail copies to liable parties within one day of filing.

• Prevents settlement or judgment releases from being valid without the hospital lienholder's consent or release, with lienholders entitled to recover reasonable hospital care costs and attorney's fees if an impaired lien action is successful.

• Act becomes effective on the first day of the third month following passage and applies only to hospital service claims arising after the effective date.
