HB126 Summary

• County commissions must require subdivision plats outside municipal corporate limits to affirmatively state whether the county has agreed to accept responsibility for maintaining any roads on the plat.

• Developers must submit proposed plats to the county commission for approval and obtain a development permit before selling, offering for sale, transferring, or leasing any lots.

• Upon first sale or transfer of a lot by a developer or home builder to a residential homeowner, the sales contract and deed must affirmatively state whether the county commission has agreed to accept the roads as county roads and maintain them.

• The requirements do not apply to sales, deeds, or transfers of land by an owner to an immediate family member, unless subsequently transferred to someone outside the immediate family.

• The act becomes effective on the first day of the third month following passage and approval by the Governor.
