HB138 Summary

• Provides civil immunity from negligence liability to persons who voluntarily and without compensation provide transportation to individuals for health care facilities or health care providers.

• Immunity applies if the transportation provider could not have reasonably anticipated the particular harm caused by their negligent act while acting as a volunteer, or if the act or omission resulted from willful or wanton misconduct.

• Immunity extends to transportation originating from an individual's residence.

• Accepting a gratuitous contribution or donation from the individual receiving transportation does not waive the provider's immunity under this section.

• Effective on the first day of the third month following passage and approval by the Governor.
