HB25 Summary

• Makes it unlawful for a person to smoke a tobacco product in a motor vehicle, whether in motion or at rest, when a child aged 14 years and under is a passenger.

• Violations are punishable by a fine not exceeding $100 for each violation.

• Defines "smoke" and "tobacco product" according to existing Alabama Code sections 22-15A-3 and 28-11-2.

• Bill is exempt from Amendment 621 requirements because it defines a new crime, and shall become effective on the first day of the third month following passage and approval by the Governor.
