HB314 - The Alabama Human Life Protection Act

• Makes abortion and attempted abortion felony offenses (Class A and Class C respectively) except when necessary to prevent serious health risk to the pregnant woman.

• Permits abortion only when an attending Alabama-licensed physician determines it is necessary to prevent serious health risk to the mother; physician determination must be confirmed in writing by a second Alabama-licensed physician within 180 days (except in medical emergencies).

• Exempts women who receive abortions from criminal and civil liability; also exempts physicians confirming serious health risk to the mother.

• Excludes from the definition of abortion procedures to terminate pregnancies with ectopic pregnancies or lethal anomalies, and procedures to remove dead unborn children or deliver prematurely to prevent maternal health risks.

• Becomes effective six months after passage and approval by the Governor; House passed April 30, 2019; Senate passed May 14, 2019.
