HB346 Summary

• Prohibits municipal and county governments from adopting or enforcing ordinances that regulate, restrict, or ban the use of auxiliary containers (bags, cups, bottles, and similar packaging made of plastic, paper, cloth, or other materials).

• Prevents local governments from imposing fees, charges, taxes, or additional sales taxes on auxiliary containers.

• Allows exceptions for curbside recycling programs, designated recycling locations, and commercial recycling programs without restriction.

• Permits local governments to enforce anti-littering ordinances and regulate auxiliary container use on government-owned property.

• Becomes effective on the first day of the third month following passage and approval by the Governor.
