HB 40 Summary

• Prohibits telephone solicitors from knowingly displaying misleading caller identification information with intent to defraud, cause harm, or wrongfully obtain anything of value.

• Exempts solicitations made on behalf of charitable institutions and solicitations where the actual party's name and phone number are displayed instead of the service provider's information.

• Makes violations of the caller identification prohibition also violations of the Deceptive Trade Practices Act (Section 8-19-1 et seq.), allowing enforcement by the Attorney General.

• Allows Attorney General's Consumer Division or district attorney offices to enforce the law depending on jurisdiction.

• Becomes effective on the first day of the third month following passage and gubernatorial approval.
