HB404 Summary

• Prohibits writing, sending, reading text-based communications, watching, recording, or capturing photos/videos on wireless devices while operating a motor vehicle on public roads.

• Prohibits handheld wireless device use for voice-based communication and physically holding wireless devices while driving, with exceptions for emergency calls, hands-free systems, navigation, and emergency responders.

• Establishes fines as traffic infractions: $50 for first violation, $100 for second violation, and $150 for third or subsequent violations.

• Assigns first and second convictions as two-point driving record violations and third or subsequent convictions as three-point violations.

• Requires law enforcement agencies to track and report monthly traffic stop statistics including stops of minority groups to the Alabama State Law Enforcement Agency, and directs collection of TNC driver accident data in uniform reports.
